# Maine Resets Packaging Stewardship Search After No Bids

Maine is rewriting its search for the private organization that will run the state’s packaging-stewardship program after the first procurement attracted no bids, a setback that leaves the program’s operating calendar unsettled. The Department of Environmental Protection [said on September 11](https://content.govdelivery.com/accounts/MEDEP/bulletins/429cf26?ref=theamericanquorum.com) that it is reviewing changes to the request for proposals and will notify stakeholders when a revised solicitation is available.

The reset follows an unsuccessful first round. DEP’s [August 20 procurement notice](https://content.govdelivery.com/accounts/MEDEP/bulletins/425dec8?ref=theamericanquorum.com) says the state issued the solicitation on June 15, set an August 18 deadline and received no proposals. The agency has not announced a new bid deadline, selected an operator or published a revised launch schedule. For municipalities and producers, that means the next binding dates will depend on the replacement procurement rather than the original planning assumptions.

## Why the operator matters

The stewardship organization is not merely a contractor handling paperwork. Under [Maine’s packaging law](https://legislature.maine.gov/statutes/38/title38sec2146.html?ref=theamericanquorum.com), DEP must contract with an organization for a 10-year term to collect producer payments, manage a dedicated fund, support municipal and producer reporting, conduct a statewide recycling-needs assessment and reimburse participating municipalities for eligible packaging-recycling costs. The law also expressly allows DEP to reopen competitive bidding when no compliant proposal is submitted.

DEP now lists implementation at step four of nine—contracting with the stewardship organization—and says it is reassessing the anticipated schedule. Registration begins only after the operator makes a mechanism available, and alternative collection-program applications do not open until DEP and the operator sign a contract.

## What towns and businesses should do now

No immediate reporting or payment deadline was created by the September 11 notice. Municipalities considering participation can continue organizing recycling-tonnage and cost records, because participating communities eventually must report recycled material and may need contractor information for cost studies. Producers can map the packaging they sell into Maine and review exemptions, but DEP says formal producer guidance is still under development.

Once operating, the program is designed to shift some packaging-management costs from municipal taxpayers to producers. DEP says fees will vary with packaging volume, recyclability and other environmental attributes, while municipal reimbursement will be based on median costs among comparable communities rather than a dollar-for-dollar refund. Certain packaging—including bottle-bill containers and qualifying architectural-paint containers—is excluded, and the law contains revenue and volume exemptions for some producers.

The practical takeaway is procedural: Maine has not canceled the program, but the state cannot move into its registration and reimbursement phases until it secures an operator.
