California’s $500,000 cryptocurrency settlement with Fidelity resolves allegations over past withdrawal restrictions, but it is not an automatic customer-refund program or a promise that every account can transfer digital assets without limits.

Attorney General Rob Bonta [announced](https://oag.ca.gov/news/press-releases/attorney-general-bonta-holds-crypto-platforms-accountable-secures-settlement?ref=theamericanquorum.com) the agreement October 16\. His office said Fidelity Digital Asset Services initially allowed customers to buy and sell cryptocurrency without moving it off the platform. The investigation followed California’s September 2024 settlement with Robinhood Crypto over a similar restriction.

The timing matters. According to DOJ, New York’s financial regulator approved withdrawal functionality in April 2025\. October’s announcement therefore should not be read as the first day California customers could withdraw cryptocurrency. The dispute concerned an earlier period, and Fidelity disputed the state’s allegation that it violated California law.

## What the agreement requires

The [signed agreement](https://oag.ca.gov/system/files/attachments/press-docs/fdas-settlement-agreement-fully-executed-10142026.pdf?ref=theamericanquorum.com) identifies Fidelity Digital Assets, National Association, as FDAS’s successor. Its signature page is dated October 13 for Fidelity and October 14 for DOJ. It provides $500,000 for the attorney general’s fees and costs and settlement of potential claims—not a distribution to customers.

Payment is due within 30 days after Fidelity receives written processing instructions. The state’s release of covered claims depends on full payment. TAQ has not independently confirmed whether that payment has been received.

The company denies wrongdoing and admits no legal violation. The document expressly says it is not a final court or governmental order and reflects no adjudication or finding of fact or law.

For ordinary accounts, the terms preserve restrictions needed for platform or account-holder security. Fidelity must give reasonable written notice if it stops offering retail transfer functionality. Tax-advantaged accounts are separately exempted from the agreement’s transfer requirement.

## Retirement accounts remain a separate product

Fidelity’s current [IRA guidance](https://www.fidelity.com/crypto/help/account-basics/fidelity-crypto-ira?ref=theamericanquorum.com) says its crypto IRAs are not available in California or Oregon. It also says crypto transfers are unavailable for those IRAs. A settlement discussing future California retirement-account plans is therefore not confirmation that residents can open that product now.

The company describes a two-account arrangement for eligible IRA customers: contributions go through a linked brokerage IRA, rather than directly into the crypto IRA. It likewise distinguishes moving dollars through the linked brokerage account from withdrawing cryptocurrency directly. These are product rules, not instructions to move retirement savings or assurances about an individual’s tax treatment.

## Different regulatory records answer different questions

A separate December 12, 2025 [OCC letter](https://www.occ.gov/news-issuances/news-releases/2025/nr-occ-2025-125d.pdf?ref=theamericanquorum.com) conditionally approved Fidelity’s national trust-bank conversion and related transactions. It described planned custody, trading and other digital-asset services, with preopening requirements. That banking authorization is a different matter from California’s resolution of historical withdrawal allegations; it is not a finding that the alleged conduct was lawful or unlawful.

This report describes the public agreement, agency records and Fidelity’s published account guidance. It does not establish a customer’s eligibility, decide a private claim or confirm settlement-payment receipt.
