A federal judge said Saturday she intends to appoint former U.S. Attorney Jessie Liu to investigate whether government lawyers and officials misled her in litigation over President Donald Trump’s planned reconstruction of East Potomac Golf Links in Washington. The proposed appointment adds an independent fact-finding step to a dispute that now concerns both the future of a public recreation area and the accuracy of the government’s representations in court.

U.S. District Judge Ana Reyes is giving the parties an opportunity to respond before naming Liu as special master, the [Associated Press](https://gmg-ksat-prod.cdn.arcpublishing.com/news/politics/2026/11/07/judge-wants-former-us-attorney-to-investigate-whether-the-government-misled-her-in-trump-golf-case/?ref=theamericanquorum.com) reported. Responses are due Friday, November 13, when another hearing is scheduled. The announcement does not establish that anyone committed an ethical violation, and it does not decide the underlying challenge to the renovation.

## What the outside inquiry would examine

The inquiry would address the conduct of Justice Department attorneys and Interior Department and National Park Service officials during a lawsuit brought in February by the DC Preservation League and two golfers. According to [CNN](https://kvia.com/politics/cnn-us-politics/2026/11/07/judge-expected-to-tap-former-us-attorney-to-investigate-possible-ethical-violations-by-trump-admin-lawyers-in-case/?ref=theamericanquorum.com), Reyes has questioned whether statements about the existence of renovation plans, the timing of work and tree removals were truthful. She opened a formal inquiry at an October 30 hearing; Saturday’s step identifies the person she wants to conduct it.

Government lawyers had maintained that tree removals were necessary and unrelated to Trump’s desired redesign, CNN reported. Reyes expressed skepticism after hundreds of trees were removed with less than a day’s notice. Her concern is therefore about what officials knew, when they knew it and what they told the court, rather than merely whether the president prefers a different golf-course design.

Liu served as the District of Columbia’s top federal prosecutor from 2017 to 2020, during Trump’s first administration, after previously working as an assistant U.S. attorney. Her prior government role provides relevant prosecutorial experience, but the proposed assignment would be a court-supervised civil inquiry. It would not make her a criminal prosecutor in this litigation or turn the appointment itself into a sanction.

## The existing order sets concrete limits

The court’s October 26 [injunction](https://democracyforward.org/wp-content/uploads/2026/10/101-Order-Granting-PI.pdf?ref=theamericanquorum.com) prohibits cutting, removing or substantially damaging additional trees at East Potomac Park without court authorization. It includes an exception for an imminent public-safety threat, with notice and a sworn explanation from a senior Park Service employee required within 24 hours. The restriction extends to damage caused by excavation, grading, soil compaction or equipment staged within a tree’s root zone.

The same order requires at least ten business days’ written notice before an unscheduled closure of the course or irreversible changes to the park’s features. Required details include the work’s scope, start date, reasons, expected impact and the names and titles of people authorizing and carrying it out. Those provisions are significant because they make the government’s plans and responsible decision-makers part of the court record before physical changes occur.

The administration has announced a November 15 closure for renovation. That announced date and the injunction are separate facts: a public statement of intent does not erase the notice requirements or resolve the parties’ disagreement about what work may proceed. The court’s order also directs officials to report attempted changes without delay.

## Access and environmental review remain disputed

The plaintiffs’ September [amended complaint](https://democracyforward.org/wp-content/uploads/2026/09/DCPL%5FUpdated%5FComplaint.pdf?ref=theamericanquorum.com) challenges the government’s actions under environmental, historic-preservation and administrative law. It raises concerns about public access, the treatment of the park’s historic landscape and the placement of material from the White House East Wing demolition at the site. These are allegations advanced by the challengers, not a final determination of liability.

The administration presents the project as an improvement to the capital. In a statement reported by [Reuters](https://www.reuters.com/legal/government/special-master-named-ethics-probe-lawsuit-over-trumps-dc-golf-project-2026-11-08/?ref=theamericanquorum.com), Interior criticized Reyes as politically motivated and accused her of obstructing Trump’s plans. The government has also sought unsuccessfully to remove her from the case. That dispute over judicial impartiality does not answer the factual question the proposed inquiry would examine: whether particular representations during the litigation were accurate.

## A special master reports to the court

[Rule 53](https://www.law.cornell.edu/rules/frcp/rule%5F53?ref=theamericanquorum.com) of the Federal Rules of Civil Procedure requires notice and an opportunity for the parties to be heard before a special master is appointed. An appointment order must define the duties, limits of authority, recordkeeping, review procedures and compensation. The rule also addresses potential conflicts of interest, requiring disclosure before the court issues the appointment.

The judge retains responsibility for acting on the master’s reports and recommendations. Parties can object, and the court may accept, modify, reject or return recommendations for more work. The rule generally requires fresh judicial review of objections to a master’s legal conclusions and, subject to specified exceptions, factual findings. That structure separates gathering the facts from deciding their consequences.

The immediate next steps are the parties’ written responses and the November 13 hearing. Until those proceedings clarify Liu’s appointment and remit, the record supports an inquiry into possible misconduct, alongside continuing restrictions on changes to the park. It does not yet support a conclusion that the investigation has found wrongdoing or that the renovation dispute has been finally resolved.
