# Garland Appoints Robert Hur Special Counsel After Classified Documents Found at Biden Office and Delaware Home

## A November discovery becomes a special-counsel investigation

The initial records were found November 2 while Biden's personal attorneys were clearing space at the Penn Biden Center, where he maintained an office after leaving the vice presidency. Biden said publicly this week that he was surprised to learn classified documents were among the records and that he did not know their contents.

Garland said he assigned U.S. Attorney John Lausch of the Northern District of Illinois to conduct an initial review on November 14\. On January 5, Lausch advised the attorney general that further investigation by a special counsel was warranted. Sauber said Saturday that he went to Wilmington on Thursday because he holds a security clearance and could facilitate transfer of a document found the previous day by Biden's personal counsel. Biden's personal attorneys have emphasized that they notified the government as records were found and arranged for federal authorities to take possession. Hur served as U.S. attorney for Maryland from 2018 to 2021 and previously held senior Justice Department roles.
